A Little History about Alex:
Alex first immigrated to America and began making jewelry with his brother to earn a living. Now Alex makes a full time income doing what he loves participating in over 40 Jewelry Shows each year. Alex’s designs are amazing and beautiful but I am a little concerned by the statement, “The Ear Vine and Ear Cuff are exclusive trademarked designs, custom made and available only by Alex himself”. There are hundreds, maybe thousands of us out here making jewelry like this. Ear cuffs have been worn for generations. I found this tip article just a trifle confusing. While I know that a person can copyright a design; I’m not so sure that actual designs can be “trademarked.” The term, “ear vines” can most likely be trademarked for sure as I have not seen or heard it used on jewelry sites before. However, the term “ear cuffs” has been used for a number of years by various jewelry designers. If in fact, it has now been trademarked by Mr. Simkin, does that mean we can no longer use the term when we sell our own designs?

A quick clarification on the Ear Vines vs. Ear Cuffs. “Ear Cuffs” has been a general term used by most designers use refer to the style of ear jewelry. Generally, ear cuffs are worn higher on the ear or need a piercing to hold them in. Alex has trademarked the name; The Ear Vine. His style of cuff and technique are unique to him. You can continue to refer to the type of jewelry as ear cuffs, however, just cannot call anything your create “The Ear Vine” – that is what’s trademarked. He is also introducing a new technique in making these particular types of Ear Vines. If you’d like to view some of his jewelry, please visit his website at http://www.eardesigns.com. The DVDs we are producing will be a 6 disc set, each with three projects which will teach you his unique technique and how to create the “Ear Vine.” The reason that you’ve not heard of it is because it has been trademarked by him, and has been a fairly kept technique for a number of years. You’ve probably seen his work, but haven’t known that it was his technique. That’s what makes this so exciting! I hope that helps!

I agree with the others I’ve known about ear cuffs it seems forever. I make them for myself and friends and have gone on youtube to see different styles from what I make and there are simply tons of them. A woman I talked to a few years ago in quartzsite made the ear vines and she said she had the exclusive copyright on them. So this seems like a very confusing situation for me and everyone else who make and sell these. The simple design has been around for years and there are all kinds of variations too.

I just checked out you tube. There is a young girl who shows three ear cuffs. Two of the cuffs aren’t at the top they’re like the “ear vine”. It seems like the style has been around although I haven’t seen the ear vine made so it may have different techniques.
I’ve seen this same issue with wire wrap jewelry. There are tutorial’s showing how to make a design and some are the persons designs but you see them for sale on sites from other’s so I don’t alway’s know who the original artist actually created the design.
